This site has been in existence for almost three years now. It has even been hit by a big guest wave from Reddit once.

If Nintendo had any real problem with it, we'd be aware by now.

I don't think Nintendo have ever taken down a rom-hacking site.

That's a ROM hosting site, which is distributing illegal ROMs. We just do something that is a very, very grey legal area.

No because the game itself is untouched, you're just taking a video of it. The video doesn't preserve the game either; it simply displays part of it.
Not hacking, Not preserving, Therefore not covered.

Literally, nobody cares. You are not going to get in trouble, in any way. Unless you have been mass/first uploading current gen games, then you might get in trouble for piracy.

Nintendo dose know about DSHack.org NOA visited us once just last year and I, thank yami said Nintendo of eruope visited us a few more times. It's been like 7 monthes since then. The only two logical answers to why they haven't done anything that I, can come up with is because 1. They don't give a shit. or, 2. They like what they see and, hope we might actually work for them one day. If they found out about this site they would most likely react the same way and, do nothing.

Nintendo is fully aware of the Mario hacking scenes.

They've actually visited a few, and the staff are aware.
