It is technically pirating. Otherwise you could post downloads for every single file individually and claim it is not pirating, cause "it's only 1 file".
EDIT: But I'm not a mod, so it is really up to them. |

Well, id say that's a bit on the extreme side, but as for the MiniRedBlueExGalaxy.arc, its technically "pirating", I would let it slide, and I think its ok as long as you upload it somewhere other than K64.
