If borderline unconstitutional crap like the NSA spying were to become illegal, would it be a good idea for the government to just nationalize all the public utilities? Or at the very least, all the public utilities are handed over the State government of the respective US State they are in?

Illegal doesn't mean they'd have to stop it. Just means they'd have to do their best to keep it a secret.
